Welcome to Loopee Windsurfing. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or purchasing products from us, you agree to these Terms and our Privacy Policy.

1. Eligibility & Account Responsibility

By using this website, you confirm that you are at least the age of majority in your jurisdiction or have the consent of a parent or guardian.

You agree to provide accurate, complete, and current account, shipping, and payment information. You are responsible for maintaining the confidentiality of your account credentials.

2. Products, Inventory & Availability

Due to the nature of the windsurfing industry, many products are sourced from manufacturers, distributors, and international suppliers. Inventory levels may change without notice and may not always reflect real-time availability.

Occasionally, products, sizes, colors, model years, or specifications may become unavailable after an order has been placed. In such cases, Loopee Windsurfing reserves the right to:

  • Remove unavailable items from an order

  • Offer a substitute product

  • Partially fulfill an order

  • Issue a refund for unavailable items

  • Cancel an order

If a customer agrees to proceed with a modified order after being notified of an unavailable product, size, color, model year, or specification, the modified order shall be considered accepted and shall be subject to the standard return policy.

Acceptance of a modified order waives any claim related solely to the unavailability of the originally ordered item.

Manufacturer specifications, graphics, colors, model years, and product details may change without notice and shall not constitute grounds for cancellation or return.

3. Pricing, Taxes & Duties

All prices are listed in U.S. Dollars (USD).

Sales tax is charged where required by law.

For orders shipped within the United States, customers are responsible only for the purchase price, applicable sales tax, and shipping charges shown at checkout. Any duties, import fees, brokerage fees, customs charges, or similar import related costs are the responsibility of Loopee Windsurfing.

If a customer in the United States receives an invoice for duties, taxes, brokerage fees, customs charges, or similar import related fees, they should contact Loopee Windsurfing before making payment. Such charges may have been issued in error and are generally the responsibility of Loopee Windsurfing.

For orders shipped outside the United States, including shipments to Canada, customers are solely responsible for all customs duties, import taxes, brokerage fees, customs clearance fees, and any other charges imposed by the destination country. These charges are not included in the purchase price or shipping charges.

Customers are encouraged to contact their local customs office or carrier prior to placing an order if they have questions regarding import duties, taxes, brokerage fees, or other import related charges.


4. Orders & Cancellations

Placing an order constitutes an offer to purchase.

Loopee Windsurfing reserves the right to refuse, cancel, or limit any order at its sole discretion.

Orders may be cancelled before shipment.

Once an order has shipped, cancellation requests will be treated as returns and will be subject to the Return Policy.

Special orders and products ordered specifically for a customer may not be cancelled once the order has been placed with the supplier.

5. Payment Methods

We accept major credit cards and PayPal.

Orders are not considered accepted until payment has been successfully processed.

6. Shipping & Delivery

Most in-stock orders ship within 24 to 48 business hours.

Delivery times are estimates only and are not guaranteed.

Loopee Windsurfing is not responsible for carrier delays, weather delays, customs delays, labor disruptions, manufacturer delays, or events beyond our control.

Title and risk of loss transfer to the customer when products are delivered to the carrier.

Shipping Costs

Shipping charges displayed at checkout may be subsidized by Loopee Windsurfing and may not reflect the actual shipping costs incurred.

In the event of a return, refund, cancellation after shipment, refused delivery, or undeliverable package, the actual outbound shipping costs paid by Loopee Windsurfing will be deducted from the customer's refund, regardless of the shipping amount charged at checkout or whether free shipping was offered.

Actual shipping costs may include:

  • Carrier charges

  • Oversized package fees

  • Residential delivery fees

  • Insurance

  • Handling charges

  • Other shipping-related expenses

7. Returns & Refunds

Returns must be authorized in advance.

Returns are accepted within 30 days of delivery for new, unused products in original packaging suitable for resale.

Customers are responsible for all return shipping costs unless the return is the result of an error made by Loopee Windsurfing.

Original shipping charges are non-refundable.

For orders receiving discounted or free shipping, the actual shipping costs incurred by Loopee Windsurfing may be deducted from the refund amount.

Refunds will be processed after inspection and approval of returned merchandise.

8. Non-Returnable Items

The following items are not eligible for return:

  • Used, rigged, mounted, installed, or modified products

  • Products not returned in original packaging

  • Custom orders

  • Special orders

  • Clearance items

  • Closeout items

  • Products ordered specifically for a customer

  • Products damaged by misuse, neglect, accident, or improper installation

Acceptance of a modified order due to manufacturer inventory shortages, discontinued products, unavailable sizes, unavailable colors, or unavailable specifications shall not constitute grounds for return outside the standard return policy.

9. Intellectual Property

All content on this website, including text, graphics, images, logos, product descriptions, and design elements, is the property of Loopee Windsurfing or its licensors and is protected by intellectual property laws.

No content may be copied, reproduced, distributed, or used without prior written consent.

10. Third-Party Services & Links

Our website may contain links to third-party websites and services.

These services are provided on an "as-is" basis. Loopee Windsurfing is not responsible for third-party content, products, services, or policies.

11. Errors, Inaccuracies & Omissions

Occasionally information on our website may contain typographical errors, inaccuracies, or omissions relating to pricing, specifications, promotions, availability, or product descriptions.

We reserve the right to correct errors and cancel affected orders at any time.

12. Customer Feedback & Reviews

Any reviews, comments, suggestions, or feedback submitted to Loopee Windsurfing may be used for business purposes without compensation.

13. Prohibited Uses

You may not use this website for:

  • Fraudulent activities

  • Illegal activities

  • Harassment or abuse

Our maximum liability shall not exceed the amount paid by the customer for the product giving rise to the claim.

You agree to indemnify and hold harmless Loopee Windsurfing, its owners, employees, suppliers, and affiliates from claims arising from your violation of these Terms or misuse of products purchased from us.

16. Governing Law

These Terms shall be governed by the laws of the State of Maryland.

Any legal action or proceeding shall be brought exclusively in the courts located within the State of Maryland.

We reserve the right to modify these Terms at any time.

Updated Terms will be posted on this page and become effective immediately upon posting.
